View working restrictions following Section 58 restrictions

Section 58 of the New Roads and Street Works Act 1991 is a legal notice which is served on all 'statutory undertakers' who carry out work across Swindon Borough. For further details, please refer to the Highways Agency website.

This restriction allows local authorities to protect sections of the highway from certain works, following substantial road works (e.g. resurfacing or reconstruction).

The Council provides advance notice of these restrictions, so that statutory undertakers (utility companies, private contractors or developers) can arrange to conduct their works in advance of the restriction coming into force. This process promotes better works planning and co-ordination, helps minimise disruption and congestion caused by works to road users, and also helps to prolong the life of the asset.

The restrictions can last up to three years following the completion of the works. Emergency works such as gas escapes, burst water mains or loss of electricity service are exempt from the restriction.

Notice of substantial road works

The details of the roadworks covered by the Section 58 restrictions are shown on the roadworks, closures and diversions map.

  • Three months' advance notice is hereby given that Swindon Borough Council (Highway Authority) intends to carry out substantial works for road purposes.
  • Work is expected to commence on the date stated or within six months of the start date shown on the roadworks, closures and diversions map.
  • Subject to the exemptions in the Act and Regulations under it, no street works may be executed for a period of three years or more from completion of the works described without the consent of Swindon Borough Council (Highway Authority), which is not unreasonably withheld.
