Find or request s106 or s52 documents
Section 106 and Section 52 agreements are legal agreements linked to planning permission. You may need copies of these documents when selling land or property.
You can find documents online for free or pay us to find them for you.
Documents you can get
You may need:
- a copy of a signed Section 106 or Section 52 deed
- a letter giving information about compliance with a Section 106 or Section 52 agreement
Section 106 and Section 52 agreements are often used for major or complex planning applications. They secure public benefits, known as planning obligations, needed to make a development acceptable.
Find documents online for free
You can search for deeds online and download them immediately.
Start by checking the list of major developments. Each planning application reference links to its documents.
Search for other developments
If the development is not listed above, search for planning documents.
You will need the original planning application reference. You can find this in the planning charges and planning decisions sections of your local land charges search.
Planning permission may have been granted before roads and properties were named. Searching by address may not show the full planning history.
If you cannot find the documents, you can pay us to find them for you.
Where deeds are stored
We usually upload a deed under the application reference for the relevant planning permission. This is often the outline or full permission, rather than a reserved matters application.
If an original deed changes, we usually store the deed of variation with the original deed. A supplemental deed linked to a new permission may appear under the new application reference.
Very few deeds for the original West Swindon and East Swindon developments are available electronically.
This includes:
- Toothill
- Freshbrook
- Westlea
- Grange Park
- Shaw
- Liden
- Dorcan
- Eldene
- Nythe
Any available deeds are stored under the relevant planning application references.
Developments outside the borough
Royal Wootton Bassett is not in the borough of Swindon. Neither are Moredon Bridge, known as Moredon View, or Ridgeway Farm off Purton Road.
These places are in Wiltshire Council's administrative area.
Information about compliance
We cannot always confirm that every planning obligation has been met.
Some obligations continue permanently and can never be discharged. If a development is still under construction, the deadline for meeting an obligation may not have passed.
Compliance information is only valid for a limited period. You should only use it to support the current property sale because the information may change.
If you are buying a property, get legal advice on whether its planning obligations will apply to you.
Ask us to provide documents
You can pay us to provide:
- copies of signed Section 106 or Section 52 deeds
- information about compliance with Section 106 or Section 52 agreements
What you need
Before you apply, you will need:
- scanned copies of the planning charges and planning decisions sections from your local search response
- the planning application reference
- a debit card
Fees
The fees, including VAT, are:
- £36 for each deed
- £175.03 for compliance information
We review these fees every year.
You can request more than one deed for the same property. You must pay £36 for each document.
For compliance information, one fee covers all deeds linked to the same property address.
How long it takes
We aim to respond within 20 working days.
It may take up to 40 working days if:
- the request is complex
- planning permission was granted before 2000
