Introduction

You need to be aware of this Privacy Notice if you are contacting Swindon Borough Council regarding an anti-social behaviour complaint, incident, enquiry or case review.

What is a Privacy Notice?

A Privacy Notice is a statement issued by an organisation which explains how personal and confidential data about individuals is collected, used and shared.

Who is collecting and using your personal data?

Swindon Borough Council will act as the data controller for any personal information you provide to us. 

Your personal data – what is it?

Any information that can be used to identify a living person is considered personal data.

Why do we need your personal information?

We collect personal data relating to witnesses, victims, alleged perpetrators of crime and anti-social behaviour. We also collect data on vulnerable individuals. The gathering of information is necessary for the service to perform a task in the public interest and in undertaking its official functions.

How the law allows us to use your information?

These functions have a clear basis in law under Article 6 GDPR 2018, the Anti-Social Behaviour Crime and Policing Act 2014, the Housing Act 1985, the Housing Act 1996 and the Prevention of Social Housing Fraud Act 2013.

Who do we share your information with?

We may share your information with other services and ask other agencies for information about you only if it is appropriate and relevant. Under the Crime & Disorder Act 1998, Section 115 we can share information with the police to prevent crime and disorder without your consent.

This information will help us deal with any issue, application or case management quickly. Other services and agencies will include but not limited to:

  • Other departments within the council
  • Wiltshire Police
  • Fire and Rescue Service
  • Health services
  • National Probation Service
  • Support agencies
  • Social housing provider
How do we protect your information?

We will maintain the reliability, accuracy, completeness and currency of personal data in our databases and to protect the privacy and security of our databases.

Our servers and databases are protected by industry standard security technology.

The employees who have access to personal data have been trained to handle such data properly and in accordance with latest regulation.

How long do we keep your personal information?

We keep your personal data only for as long as reasonably necessary for the purposes for which it was collected.

What you can do with your information?

You have various rights around the data we hold about you:

  • Right of access (to receive a copy of your personal data)
  • Right to rectification (to request data is corrected inaccurate)
  • Right to restrict processing (to request we don’t use your data in a certain way)
  • Right to data portability (in some cases, you can ask to receive a copy of your data in a commonly used electronic format so that it can be given to someone else)
  • Right to object (generally to make a complaint about any aspect of our use of your data)
  • Right to have explained if there will be any automated decision-making, including profiling, based on your data and for the logic behind this to be explained to you.

Any such request can be submitted to the Data Protection Officer. Whether we can agree to your request will depend on the specific circumstances and if we cannot then we will explain the reasons why.

Your right to complain

If you are unhappy with any aspect of how your information has been collected and/or used, you can make a complaint to the Data Protection Officer. You can also report concerns to the national regulator, the Information Commissioner’s Office (ICO) by visiting the ICO website.

What if you do not provide personal data?

If you make an anonymous complaint about anti-social behaviour, Swindon Borough Council will review your complaint and take any appropriate action based on the information provided, but we will be unable to share any updates with you.
