Introduction

The Carer Support Scheme has been introduced to help health and social care professionals respond to the needs of carers whose health is being affected by their caring role. It offers a one-off direct payment to carers within the Swindon Borough Council / NHS Swindon area, with the aim of giving carers choice and control over the support they receive.

As part of the application process, Swindon Borough Council collects and processes personal data relating to carers and the person they care for. We are committed to being transparent about how we collect and use that data and to meeting our data protection obligations. The Carer Support Scheme is a partnership between Swindon Borough Council and CCG Swindon. The information provided is important as it will help us to process applications and possibly identify other ways we can help carers.

What is a Privacy Notice?

A ‘Privacy Notice’ is a statement issued by an organisation which explains how personal and confidential data about individuals is collected, used and shared.

What personal data do we collect?

Swindon Borough Council collects a range of personal data about you when you apply to the Carers Support Scheme for a Direct Payment.

This includes:

  • Your name, address and contact details, including email address and telephone number
  • Your date of birth
  • Your ethnicity
  • Details of any condition/illness you may have
  • Name, address and date of birth of the person you care for
  • Details of the specific condition/illness the person you care for has
How do we process your personal data?

We need to process this data to assess your level of need and whether the scheme will help to meet the outcomes in your carers assessment.

We also collect data about your ethnicity. We process such data to carry out our obligations in assessing whether our services are reaching all sections of the community.

Who do we share your information with?

Your data may be shared internally for the purposes of assessing what help you receive from other teams within Swindon Borough Council. We will not share your data with third parties.

How do we protect your information?

Personal data will be stored in a range of different places, including on a spreadsheet held by the Voluntary and Third Sector Commissioning team and on other IT systems in the Direct Payments team. Any paper-based documentation is sent to the Direct Payments team and is no longer held by the Voluntary and Third Sector Commissioning team.

We take the security of your personal data seriously. We have internal policies and controls in place to ensure that your personal data is not lost, accidentally destroyed, misused or disclosed, and is not accessed except by our employees in the proper performance of their duties.

How long do we keep your personal information?

If your application is successful, personal data (electronic) gathered during the application process will be held and retained by the Voluntary and Third Sector Commissioning team for a period of up to three years. This is for us to be able to monitor repeat applications and ensure you do not receive more than one payment per year. After this time your personal data will be deleted from the system. If your application is unsuccessful, we will keep your details on file for one year. If you decide that you want your data to be removed from the system, email our Information Governance team.

What you can do with your information?

You have a number of rights. You can:

  • access and obtain a copy of your data on request (Subject Access Request)
  • require us to change incorrect or incomplete data
  • require us to delete or stop processing your data, for example where the data is no longer necessary for the purposes of processing
  • object to the processing of your data where we are relying on our legitimate interests as the legal ground for processing

If you would like to exercise any of these rights, contact our data protection officer. If you believe we have not complied with your data protection rights, you can complain to the Information Commissioner.

What if you do not provide personal data?

You are under no statutory or contractual obligation to provide data to Swindon Borough Council during the Carer Support Scheme application process. However, if you do not provide the data, we will not be able to process your application.

How will we ensure compliance?

A yearly audit will take place on carers’ data to ensure that we remain legally compliant in accordance with current data protection legislation.
