Making a Claim for Personal Injury

If you believe you have suffered an injury as a result of Council negligence, please complete and return the claim form (please see below).

To assist in site identification, you must provide a sketched plan and photographs showing the exact location. If the incident occurred outside a dwelling please include the house number. If our Highways Inspectors are unable to identify the precise location of the alleged defect from the information given by you we will have to contact you again for further information and the claim investigation will be delayed.

To be successful claimants’ must not only prove that they have suffered an injury or loss but that the Council has breached its statutory duty to maintain the highway. Determining negligence depends upon a number of factors including current legislation and tolerances allowable by the courts.
