There has been concern expressed that the current system of set penalty regardless of the severity of contravention is unfair. For example a driver who overstays their ticket time in a car park is currently penalised the same amount as a person who has caused a danger to other road users by parking on a yellow line or on a bus stop or disabled bay.

The TMA requires authorities to introduce two levels of penalty charges, which are considered fairer in that they relate to the seriousness of the contravention. Swindon has adopted The Higher contravention Price band at £70 (£35) and the lower contravention at £50 (£25).
