The government, in the Housing Act 2004, has introduced a compulsory licensing scheme for Houses in Multiple Occupation (HMO) over a certain size. The licensing scheme aims to protect tenants by imposing requirements on landlords to maintain and manage their properties in a way that protects their often vulnerable tenants
From November 2005, certain large houses where unrelated people live together and share facilities such as bathrooms, kitchens, living areas etc need to be licensed by the Local Authority.
Initially, houses of 3 storeys or more, containing 5 or more people, some or all of which share some facilities must be licensed by Swindon Borough Council. This will include bedsits and shared houses, but will not apply to houses converted solely into self-contained flats. Houses owned by Housing Associations or Trusts are also excluded.
If the house that you live in is 3 storeys or more high, contains 5 or more people, and there is some sharing of facilities, then it must be licensed.
There are stiff penalties, of up to £20,000 for failing to licence a qualifying HMO, including the possible claiming back of rent by tenants for the unlicensed period.
